What To Do After Your Hearing
Chapter 7 Clients: After your Trustee hearing your bankruptcy discharge should be issued in approximately 60 days if all information that the trustee requests is provided promptly.
- Vehicle Reaffirmation – If you have a vehicle you wish to retain that has a lien against it a reaffirmation has to be executed with the lender to insure you can keep the vehicle. This reaffirmation will be sent to you by mail and must be signed and returned. We have until your discharge (60 days) to submit the reaffirmation to the court for approval.
- Financial Management Certificate – If you have not completed and submitted your 2nd certificate prior to your Trustee hearing you will need to complete it before your bankruptcy discharge or you case will close without a discharge.
Chapter 13 Clients – After your Trustee hearing you are required to provide any additional documents requested at the hearing.
- Make Plan Payments – In order to not have your case dismiss you must make your plan payment on time.
- Provide Updates – You are required to update the court of any substantial increase in income or any windfall in income or value.
- Obey Credit Restrictions – You are under court order to request court permission to incur any credit greater than $4,999 or of the purchase of any property greater than that value. This restriction applies to refinancing a property, student loans, tax refund advance loans, vehicle purchases, home improvement loans, and any other credit lending.
- Pay Support and Mortgage Payments – If you have domestic support obligation or a mortgage you are continuing to pay during your plan, you need to be aware that you may be ineligble to get a discharge at the end of your case if you do not make all payments during the course of your case.
