Prior Homestead Deeds

If you filed a prior Homestead Deed we will need a copy.  Here are a list of situations where you may have filed a prior homestead deed:
  1. If you filed a prior Chapter 7 anytime in the past, the likelihood is very high that you filed a prior homestead deed.
  2. If you were garnished and were able to recover some of the money, the likelihood is you did it with a homestead deed.
General rule: When in doubt, you should call the Land Records office in the Circuit Court of any county or city you lived in at the time of the filing of any prior Chapter 7 or any garnishment.   Do not assume you did not file a homestead deed because you do not remember your attorney or yourself filing one.  Call to make sure.  If you don’t and are wrong you may lose some property. This only applies to bankruptcies filed in Virginia and garnishments issued in a Virginia court.
